These Terms of Service (“Terms”) govern your access to and use of WhatsCRM, including our website, web application, mobile applications, and related services (collectively, the “Service”).
By accessing or using WhatsCRM, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
“WhatsCRM,” “we,” “us,” “our” refers to the operators of the WhatsCRM platform.
“User,” “you,” “your” refers to any individual or entity using the Service.
“Customer Data” means data you process using WhatsCRM relating to your customers or contacts.
“Meta” refers to Meta Platforms, Inc., including WhatsApp services.
2. Eligibility
You must be at least 18 years old and legally capable of entering a binding agreement to use WhatsCRM.
By using the Service on behalf of a business, you confirm that you have authority to bind that entity.
3. Description of Service
WhatsCRM provides tools for:
WhatsApp customer communication
Automation and messaging workflows
Campaign management
Contact and conversation management
Analytics and reporting
WhatsCRM integrates with the WhatsApp Cloud API and related Meta services.
4. Account Registration
To use the Service, you must create an account and provide accurate, current information.
You are responsible for:
Maintaining the confidentiality of your credentials
All activity conducted through your account
We reserve the right to suspend or terminate accounts for violations of these Terms.
5. Acceptable Use
You agree not to use WhatsCRM to:
Send spam, unsolicited, or deceptive messages
Violate WhatsApp, Meta, or local telecommunications policies
Infringe intellectual property or privacy rights
Transmit malware or harmful code
Engage in illegal or abusive activity
You are solely responsible for compliance with:
WhatsApp Business policies
Local data protection and consumer laws
Messaging consent requirements
6. WhatsApp & Third-Party Services
WhatsCRM relies on third-party services, including Meta’s WhatsApp Cloud API.
We do not control and are not responsible for:
WhatsApp service availability
Message delivery success
Changes to Meta policies or pricing
Your use of WhatsApp services is also subject to Meta’s terms and policies.
7. Subscriptions & Payments
Some features require a paid subscription.
Prices are displayed on the platform and may change with notice
Subscriptions are billed monthly or yearly
WhatsCRM fees do not include WhatsApp message charges imposed by Meta
Failure to pay may result in suspension or termination of access.
8. Free Trials
Free trials, if offered:
Are limited in time and features
May not include all functionality
May be terminated at our discretion
We reserve the right to modify or discontinue trial offers.
9. Data & Privacy
We process personal data in accordance with our Privacy Policy.
You:
Own and control your Customer Data
Are responsible for obtaining customer consent
Grant WhatsCRM permission to process data solely to provide the Service
WhatsCRM acts as a data processor, not the data controller.
10. Intellectual Property
All rights to WhatsCRM, including software, branding, and content, belong to us or our licensors.
You may not:
Copy, modify, or resell the Service
Reverse engineer or attempt to extract source code
Use branding without written permission
11. Service Availability
We aim for reliable uptime but do not guarantee uninterrupted service.
WhatsCRM may be unavailable due to:
Maintenance
Third-party outages
Force majeure events
We are not liable for downtime beyond our reasonable control.
12. Termination
You may stop using the Service at any time.
We may suspend or terminate access if:
You violate these Terms
Required by law or Meta policies
Your use poses risk to the platform or others
Upon termination, access to data may be limited or deleted according to our retention policy.
13. Disclaimers
The Service is provided “as is” and “as available.”
We disclaim all warranties, including:
Fitness for a particular purpose
Accuracy or reliability of messaging delivery
Compliance with specific legal requirements
14. Limitation of Liability
To the maximum extent permitted by law, WhatsCRM shall not be liable for:
Indirect or consequential damages
Loss of profits, data, or business
Issues arising from WhatsApp or third-party services
Our total liability shall not exceed the amount paid by you in the preceding 12 months.
15. Indemnification
You agree to indemnify and hold WhatsCRM harmless from claims arising from:
Your misuse of the Service
Violations of laws or third-party rights
Content or messages you send using the platform
16. Changes to Terms
We may update these Terms periodically.
Continued use of the Service constitutes acceptance of updated Terms.
17. Governing Law
